policy applies to all appointed SM staff represented by AFSCME,
Local 1477. |
|
Reduction
in force
|
A
person who is reappointed in any department within 15 months after
being terminated from the university because of a permanent
reduction in force, will have the benefits listed below restored.
- Unused
sick time
- Length
of service credit as of the termination date for vacation
- Accumulated
vacation time (in excess of the terminal vacation allowance
for which the employee did not receive terminal pay)

Voluntary
termination |
An
employee who voluntarily terminates from an appointed position
may receive credit (not seniority) for prior service to
determine the vacation accrual rate. Both the following
conditions must be met. The employee must:
- Be
reemployed within 15 months
- Be
reemployed in the same position—or an appointed position
within the same functional classification—on the same
campus

Medical-related
termination |
An
employee who is appointed in any department within 12 months of
a medical-related termination is entitled to reinstatement of
seniority benefits accrued as of the day of termination. Events
that apply to this provision are limited to the following:
- Termination
for pregnancy
- Termination
for postnatal infant care (for approximately the first year
of life)
- Termination
due to sickness or bodily injury that totally disabled the
employee from fulfilling his or her former position
Upon
appointment, the employee will have the following seniority
benefits restored:
- Accumulated
vacation time for which the person did not receive terminal
pay
- Unused
sick time
- University
seniority minus the time the person was not employed
- Occupational
unit seniority, minus the time the person was not employed,
provided the person is reemployed in the same occupational
unit

Military
termination |
Appointed
staff other than those in temporary positions who terminate to
enter military service are entitled to reappointment benefits
when they complete military duty. Depending on the length of
service, employees must apply (verbally or in writing) for
reappointment within the time limits stated below.

Employees must be allowed a “reasonable” amount of time to
return home, rest, and travel to their place of employment.
If
an employee is hospitalized or recovering from an injury
caused by active duty, the time limit for applying for
reappointment is two years (or more under extenuating
circumstances). (See Policy 10.7, Leaves of Absence:
Discretionary and Extended Military, for related.)
Reappointment
benefits should restore the veteran to the status that he or she
would have enjoyed as an employee. This includes working
conditions established by one’s length of service.
The
university’s obligation covers a maximum period of four years
of military service. This four-year maximum is extended to five
years if the additional year is at the request of and for the
convenience of the Federal Government. The extension applies
even if the additional year is voluntary on the employee’s
part.

Vacation
usage |
SM
staff reemployed under any conditions outlined above may use
accumulated time off after receipt of their first paycheck.
