Relation
to State Board of Education or IU Board of Trustees
Persons who are related by blood, marriage, adoption, or
same-sex domestic partnership to a member of the State Board
of Education, or a member of the Board of Trustees of Indiana
University may not be recommended for employment in an appointed
position.
Relationships
of immediate supervision
Indiana University does not hire or transfer close family
members related by blood, marriage, adoption, or same-sex domestic
partnership into positions that create a relationship of immediate
supervision (supervisor to employee) between two people.
This restriction includes the employment or transfer of full-time,
part-time, hourly, and temporary employees.

Definitions

Relation
by blood or adoption
Family members related by blood or adoption that fall under
this policy include these persons: parent, child, grandparent,
grandchild, brother, sister, uncle, aunt, nephew, niece, and
first cousin.
Relation
by marriage or same-sex domestic partnership
Family members related by marriage that fall under this
policy include these persons: spouse as defined by Indiana law,
same-sex domestic partner as qualified by the universitys
Affidavit of Domestic Partnership, stepparent, stepchild, brother-in-law,
sister-in-law, father-in-law, mother-in-law, son-in-law, daughter-in-law,
half-sister, half-brother, uncle, aunt, nephew, niece, or relations
of the same degree to the same-sex domestic partner.

What
is "immediate supervision?"
|
The chancellor
makes the final determination regarding what is immediate supervision
based on two standards:
- Does
the supervision involve day-to-day functions?
- Is the
supervisor the only one who is competent to judge hiring,
retention, promotion, and salary issues?

When
marriage creates a relationship of "immediate supervision"
|
If a marriage
or same-sex domestic partnership creates a relationship of immediate
supervision, one of the persons affected must give up his or
her position by one of the following dates, whichever is greater:
- By the
end of the fiscal year
- No later
than six months after the marriage
The person
giving up a position may be reemployed elsewhere in the university.
If the two individuals cannot agree on who will leave, the one
with less service must look for other employment.
